{"id":28438,"date":"2019-01-03T18:42:53","date_gmt":"2019-01-03T23:42:53","guid":{"rendered":"https:\/\/www.backtobasicslearning.com\/?p=28438"},"modified":"2019-01-03T18:42:53","modified_gmt":"2019-01-03T23:42:53","slug":"public-domain","status":"publish","type":"post","link":"https:\/\/backtobasicslearning.com\/public-domain\/","title":{"rendered":"Celebrating Public Domain"},"content":{"rendered":"<p class=\"p2\">For the <a href=\"https:\/\/mymodernmet.com\/public-domain-day-2019\/\" target=\"_blank\" rel=\"noopener\"><span class=\"s1\">first time in 20 years<\/span><\/a>, new\u2014 or rather, old\u2014 published works have entered the U.S. public domain.<\/p>\n<p class=\"p2\">What does this mean? <strong>Well, consider some burning questions.<\/strong><\/p>\n<p class=\"p2\">Like how much of the poem \u201cStopping by Woods on a Snowy Evening\u201d by Robert Frost can a teacher publish in a commercial instructional text?<\/p>\n<p class=\"p2\">Could a choir sing \u201cYes! We Have No Bananas\u201d without licensing agreements?<\/p>\n<p class=\"p2\">Could a theatre ensemble produce Willis Richardson&#8217;s &#8220;<a href=\"https:\/\/www.revolvy.com\/page\/The-Chip-Woman%27s-Fortune\" target=\"_blank\" rel=\"noopener\">The Chip Woman&#8217;s Fortune<\/a>&#8220;\u2014 the first Broadway play produced by an African-American author?<\/p>\n<p class=\"p2\"><strong>Yes, we were wondering, just like you.\u00a0?<\/strong><\/p>\n<p class=\"p2\">The answer to all of those question is a clear <i>yes <\/i>as of the new year. These works published in 1923 are now free for all to use and remix without permission or fee, according to the <a href=\"https:\/\/law.duke.edu\/cspd\/publicdomainday\/2019\/\" target=\"_blank\" rel=\"noopener\"><span class=\"s1\">Center for Study of the Public Domain<\/span><\/a>.<\/p>\n<p class=\"p2\">Prior to 1998, the copyright term was 75 years for works copyrighted before 1978. But in 1998, President Clinton signed the Copyright Term Extension Act, which retroactively extended copyright protection to 95 years for works copyrighted in 1923 or afterward.<\/p>\n<p class=\"p2\"><em>This means that new-old works haven\u2019t entered the public domain in 20 years.<\/em><\/p>\n<p class=\"p2\">This also means that Mickey Mouse\u2014who first starred in \u201cSteamboat Willie\u201d in 1928\u2014 won\u2019t enter the public domain until 2024. (Detractors of the legislation called this legislation the \u201cMickey Mouse Protection Act.\u201d)<\/p>\n<p class=\"p2\">Kahlil Gibran\u2019s \u201cThe Prophet\u201d is now public domain, and so is Agatha Christie\u2019s \u201cThe Murder on the Links.\u201d Feel free to share and re-publish <a href=\"https:\/\/en.wikipedia.org\/wiki\/Felix_the_Cat\" target=\"_blank\" rel=\"noopener\"><span class=\"s1\">Felix the Cat<\/span><\/a>. Your school could now host a screening of Cecil B. DeMille\u2019s \u201cThe Ten Commandments\u201d for discussion and analysis. (We\u2019ll bring the popcorn.)<\/p>\n<p><iframe loading=\"lazy\" src=\"https:\/\/archive.org\/embed\/TheTenCommandments1923NR_201503\" width=\"640\" height=\"480\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><br \/>\nOf course, even before January 1, 2019, educators could share excerpts of these works and claim fair use. The fair use doctrine permits excerpts of material that is protected by copyright to be used for education, research, criticism, or journalism\u2014and not for profit.<\/p>\n<p class=\"p2\">But in the internet age, what happens when teachers <a href=\"https:\/\/www.edweek.org\/ew\/articles\/2018\/12\/19\/on-teachers-pay-teachers-some-sellers-are.html\" target=\"_blank\" rel=\"noopener\"><span class=\"s1\">sell lesson plans on the internet<\/span><\/a> that contain copyrighted content?
